New International Study Presents a Strategic Guide for Enforcing Social Rights in Court
Research published in December 2025 establishes for the first time the key criteria for successful litigation that holds states accountable for the progressive realization of economic, social, and cultural rights. The article, titled “Litigation on the Progressive Realisation of Economic, Social and Cultural Rights: Under What Conditions May It Be Strategic?”, analyzes the legal and strategic conditions that enable activists and lawyers to turn these rights into tangible judicial victories.
The study, produced by an international team of experts including Koldo Casla, Juli Ponce, Marion Sandner, María José Aldanas, Rafael Cid, and Irene Escorihuela, identifies seven essential pillars for litigation, ranging from the existence of the legal obligation to the central role of civil society.
