Brief historical overview of housing regulation in Spain

Professor Juli Ponce Solé, Professor of Administrative Law at the Faculty of Law of the University of Barcelona, has recently published a brief historical overview of Spanish legislation on housing in collaboration with UGT. The purpose of this text is to present the basic state and regional legal developments and to more clearly appreciate the evolution that has taken place up to the approval of State Law 12/2023, of 24 May, the first state housing law since the approval of the 1978 Constitution.

The presentation of his contribution is divided into two major historical periods, establishing the approval of the 1978 Constitution as the dividing milestone. Likewise, with regard to the pre-Constitution period, another historical division is made between the situation in the 19th century and the 20th century, and within the latter between the period before the Spanish Civil War and the subsequent phases.
